Welcome to Marshear Beauty. These Terms of Service ("Terms") apply to the website www.marshear.com.my (the "Site") and to every order you place with us. By browsing the Site or placing an order you agree to these Terms, together with our Shipping policy, Refund policy and Privacy policy, which form part of them. Please read them carefully. If you do not agree, please do not use the Site.

1. About us

The Site is operated by Marshear HWS Sdn Bhd (Company Registration No. 1296370-D), trading as Marshear Beauty, of 52, Jalan Putra Indah 9/8, 47650 Subang Jaya, Selangor, Malaysia. You can reach us by email at admin@marshear.com.my or by WhatsApp at 012-683 2215.

2. Using the Site

You must be at least 18 years old, or using the Site with the consent of a parent or guardian, to place an order. You agree to use the Site only for lawful purposes and not to copy, scrape, resell or interfere with any part of it, attempt to gain unauthorised access to it, or use it in a way that could damage or impair it for other visitors.

3. Products

We sell skincare, makeup, body, hair and fragrance products sourced from authorised distributors. Product descriptions, ingredients and images are provided by the brands and reproduced as accurately as we can, but packaging, shade and formulation can change from batch to batch and colours may display differently on different screens. Products are intended for personal, non-commercial use. Always read the label before use, and stop using a product if irritation occurs. All products are subject to availability and we may withdraw a product at any time.

4. Prices and payment

All prices are shown in Malaysian Ringgit (RM) and include any applicable taxes. Delivery charges are shown separately at checkout before you pay. We may change prices at any time, but a change will not affect an order we have already confirmed. Payment is taken in full at the time of ordering through our secure payment gateway, which accepts the payment methods shown at checkout. Your card and banking details are handled by the payment provider and are never stored by us. If a product has been listed at an incorrect price or with incorrect information because of a typographical or system error, we may cancel the order and refund you in full, even after you have received an order confirmation.

5. Orders

An order is an offer to buy. We will send you an email acknowledging your order, but a contract is only formed when we dispatch the goods and send you a shipping confirmation. We may decline or cancel an order, for example where the product is out of stock, a price or description was wrong, payment cannot be verified, we suspect fraud or misuse, or the quantity ordered is unreasonable for personal use. If we cancel an order that you have paid for, we will refund the full amount to your original payment method. Please check your order details, delivery address and phone number carefully before you confirm; see our Shipping policy for what happens if an address is incorrect.

6. Delivery

We deliver within Malaysia only, using J&T Express. Delivery charges, free-delivery thresholds, processing and delivery times, tracking and what to do if a parcel is damaged or missing are set out in our Shipping policy. Delivery times are estimates and are not guaranteed. Risk in the goods passes to you when the parcel is delivered to the address you gave us.

7. Returns, refunds and cancellations

Your rights to return an item, to receive a replacement or refund for a damaged, faulty or wrong item, and to cancel an order before dispatch are described in our Refund policy. For hygiene reasons, opened or used skincare, makeup and fragrance cannot be returned unless faulty. Nothing in these Terms limits any rights you have under the Consumer Protection Act 1999 or other applicable Malaysian law.

8. Promotions and discount codes

Discount codes, free-shipping offers, gifts with purchase and other promotions are subject to the conditions published with them, are valid only for the stated period, cannot be exchanged for cash and cannot be combined unless we say so. We may withdraw or amend a promotion at any time, and we may cancel orders that abuse a promotion.

9. Your account

You may order as a guest or create an account. You are responsible for keeping your login details confidential and for all activity under your account. Please tell us immediately if you believe your account has been used without your permission. You must give us accurate, current information and update it when it changes.

10. Intellectual property

The Site, its layout, text, graphics and the Marshear Beauty name and logo belong to us or our licensors. Brand names, product images and trademarks belong to their respective owners and are used to identify the products we sell. You may not use any of this content for commercial purposes without written permission.

11. Our liability

We supply products for your personal use and are not liable for any business loss. To the fullest extent permitted by law, our total liability to you in connection with an order is limited to the amount you paid for that order. We do not exclude or limit our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under Malaysian law. We are not responsible for delays or failures caused by events outside our reasonable control, such as courier disruption, severe weather or government action.

12. Privacy

We collect and use your personal information in accordance with our Privacy policy and the Personal Data Protection Act 2010.

13. Third-party links

The Site may contain links to third-party websites, including brand and courier websites. We are not responsible for their content or their handling of your data.

14. Changes to these Terms

We may update these Terms from time to time. The version shown on the Site when you place an order is the one that applies to that order. Continued use of the Site after a change means you accept the updated Terms.

15. Governing law

These Terms are governed by the laws of Malaysia, and any dispute will be subject to the jurisdiction of the Malaysian courts. If any part of these Terms is found to be unenforceable, the rest continues to apply.
